Visa and Immigration Process for Recruitment in the United Arab Emirates

Hiring in the UAE requires the issuance of a residence visa and a work permit for the new employee, directly linked to your company. In case of contract termination, the visa is cancelled. For obtaining this visa, two procedures are possible :

Visa from Outside the Country :
The visa process is initiated while the future employee is outside of the UAE.

Visa from Inside the Country Visa :
The future employee enters the UAE with a tourist visa and then begins the process of obtaining a work visa. For Schengen passport holders, a tourist visa of 3 months per 6-month period is included, no need to undertake any procedures.

Required Documents:
Diploma legalized by the Embassy of the UAE in the country of origin and translated, then legalized by the UAE Ministry of Foreign Affairs.
A clear scanned copy of the passport.
A recent passport-sized photograph.
The signed offer letter.

Expected Timeframes :
Legalization of the diploma in France: approximately one month.
The timeframe varies depending on the chosen procedure after receiving all documents.

Visa from Outside the Country :
2 weeks from the submission for the visa application to obtain the entry permit. After this period, the employee enters the UAE under the work visa process and is allowed to start their employment contract immediately.
An additional 3 weeks in the UAE for obtaining the work visa and Emirates ID, necessary for accommodation and opening a bank account. Medical examinations are required, which we can undertake the day after arrival, followed by the signing of the employment contract.

Visa on Arrival :
The future employee can travel to the UAE under the cover of a tourist visa (automatic with a Schengen passport).
Allow approximately 1 month for obtaining the work visa and Emirates ID after submitting the application.

Types of Employment Contracts

In the UAE, only fixed-term contracts with automatic renewal exist.

Probation Period

The duration of the probation period may vary, but it is generally six months for employees governed by the UAE Labour Law. During this period, the employer or the employee can terminate the contract without notice. Generally, the probation period is not renewable.

Working Hours and Overtime

The standard workweek in the United Arab Emirates is 5 days, from Monday to Friday, with a daily duration of 8 hours. For most professional sectors, the limit is 48 hours of work per week.

Generally, overtime is paid at a rate of 125% for weekdays and 150% for public holidays and rest hours.

The rest day is typically Friday, in line with Islamic traditions.

Paid Annual Leave

This leave is taken after a minimum working period of between 6 months and 1 year, depending on company policy. Generally speaking, the law stipulates that annual leave cannot be less than 2 working days per month for employees who have worked less than a year, and 30 working days for those who have worked more than a year. However, if the employee does not take their annual leave during the year, some companies allow the carryover of unused days to the following year, but this may be subject to conditions at the discretion of the company.

In addition, employees may be entitled to exceptional leave for specific events such as marriage or family bereavement. The durations and conditions of these events vary depending on various factors.

Arabic is the official language of this country and is also used in business. Compensation

This country has not implemented a minimum wage, with salaries often determined through individual negotiations.

Termination of the employment contract by the employer

Termination must be for just cause, in accordance with UAE labour law. Just cause may include unsatisfactory performance, serious misconduct, or economic circumstances justifying the reduction of staff. The employer must give notice to the employee in accordance with the provisions of the employment contract. The length of the notice period depends on the reason for termination and the terms specified in the contract.

In some cases, particularly for expatriates, the employer must coordinate the termination with the relevant authorities, such as the Ministry of Human Resources and Social Emancipation.
